Chapter One General
Article 1. These articles are made in accordance with the Measures to Further Boost the Development of the Modern Shipping Service Industry in Huangpu District, Guangzhou Development District and Guangzhou High-Tech District (Huangpu Government Regulations, [2020] No 14, referred to as the "measures" hereinafter) and with due consideration to the current situation.
Article 2. These articles shall apply to all modern shipping service enterprises or organizations whose registration, taxation and statistical affairs take place within Huangpu district, Guangzhou Development District and parks under their trusteeship or their rule (hereafter all referred to as "the area"), and that have a sound accounting system, exist as an independent corporation and carry out independent accounting (excluding those qualified elsewhere under these articles).
These articles also apply to those enterprises or organizations that, although under the rule of the provincial or municipal taxation authorities, satisfy the other requirements of Article 1.
Article 3. For the purpose of the measures, the term "modern shipping service enterprise" means any service enterprise specializing in shipping finance (quasi-finance); shipping exchange; cruiser, yacht and pleasure boat services; in shipping logistics (excluding storage and stevedoring), ship management, bonded provisions for ships, non-vessel operating carriage, ship technical services (excluding ship repair and shipbuilding), ship bunkering, shipping agency, etc.; or in smart shipping services, shipping legal services, shipping brokerage, shipping e-commercial services, shipping information services, shipping talent services, shipping cultural services, seafarer services, classification services, etc. The term "organization" means any functional body in maritime arbitration and jurisdiction, shipping think tank, specialized association, research institute, or certification authority.
Article 4. Enterprises or organizations who apply for the incentive funds under the measures shall submit a letter promising their full knowledge of the relevant incentive policies and agreements. If such enterprises or organizations break their promise, they shall, on their own, return the relevant incentive funds they have collected.
Article 5. Enterprises within the area who branch out, change their name, separate their business, etc. will receive no support under these articles. Enterprises already existing within the area shall not apply for incentives as a start-up after their name alteration. Nevertheless, their qualification to continue to apply for incentives as existing enterprises is intact.
Chapter Two Verification of Industrial Qualification
Article 6. Industrial qualification is assessed based on the relevant enterprise's business scope and actually-operated primary business, as well as through consulting its shipping service-related documents, including business contracts (business commission documents), transaction credentials (invoices), etc. And, on account of the specialty of the industry, relevant qualification and compliance certificates shall be provided if required. The industrial qualification of functional shipping organizations will be assessed based on their influence at home and abroad and their rank and scale.
Article 7. Verification procedures for relevant enterprises or organizations are as follows:
1). The Huangpu Harbor-bordering Economic Zone Administrative Committee will, after examining the relevant documents of an applicant enterprise, consult by letter with the area's market management administration, construction and transportation administration and other related departments to identify the business type of the applicant enterprise, and determine whether the applicant enterprise is a modern shipping service enterprise as defined for the purpose of the measures.
2). The Huangpu Harbor-bordering Economic Zone Administrative Committee shall organize a panel of experts to assess the enterprise's industrial qualification. It will issue a verdict in writing on the industrial qualification of the enterprise after consulting the reply letters from the various functional departments and the assessment report by the panel of experts.
3). An affirmative verdict in writing on industrial qualification issued by the Huangpu Harbor-bordering Economic Zone Administrative Committee shall be a prerequisite for individual fund-releasing departments to discharge various incentives under the measures.
Article 8. International-order functional shipping organizations shall have established business contact with shipping enterprises or organizations in at least 10 major states or regions with seaports, which is to be evidenced with the provision of business contracts (business commission documents).
National-order functional shipping organizations must have established business contact with shipping enterprises or organizations in at least five major port cities in the country, which is to be evidenced with the provision of business contracts (business commission documents).
Regional-order functional shipping organizations must have established business contact with shipping enterprises or organizations in at least three port cities in the Guangdong-Hong Kong-Macao Greater Bay Area (including Guangzhou, Foshan, Zhaoqing, Shenzhen, Dongguan, Huizhou, Zhuhai, Zhongshan, and Jiangmen, and Hong Kong and Macao SARs), which is to be evidenced with the provision of business contracts (business commission documents).
Chapter Three Project Entry Award
Article 9. The Project Entry Award will be discharged in two stages to newly-founded enterprises meeting the requirements of the first three subparagraphs in Article 3 of the measures. Relevant applicant qualifications and levels of the award are as follows:
1). For enterprises meeting the following requirements, the first-stage award will be issued at 50 percent of the set sums:
(1). Enterprises must have been founded after the measures have come into force and specialize in shipping finance (quasi-finance); shipping exchange; cruiser, yacht and pleasure boat services, with a paid registered capital of 50 million yuan ($7.84 million) or more; in shipping logistics (excluding storage and stevedoring), ship management, bonded provisions for ships, non-vessel operating carriage, ship technical services (excluding ship repair and building), ship bunkering, shipping agency, etc. with a paid registered capital of 10 million yuan or more; or in smart shipping services, shipping legal services, shipping brokerage, shipping e-commercial services, shipping information services, shipping talent services, shipping cultural services, seafarer services, classification services, etc., with a paid registered capital of 2 million yuan or more;
(2). Enterprises must sign a letter of commitment;
(3). Enterprises must reach the designated size (the cut-off level) or above according to the area's statistics within the term of validity of the measures;
(4). Enterprises must pass the industrial qualification verification carried out by the Huangpu Harbor-bordering Economic Zone Administrative Committee.
2). To qualified enterprises that have made a contribution of 500,000 yuan or more to the local economy in the particular year within the term of validity of the measures, the second-stage award, namely the rest 50 percent of the set sums, will be issued.
3). The sums of the award will be determined according to the paid registered capital of enterprises at the time when they apply for their first-stage award. They will receive no additional award even if their paid registered capital has increased by the time when they apply for their second-stage award. If an enterprise meets the requirements for both the first and second-stage discharges, it can collect its full award at once.
Article 10. To new shipping organizations, including maritime arbitration and jurisdiction organizations, shipping think tanks, specialized associations, research institutes, certification authorities, etc., a one-time award will be granted according to their influence at home and abroad and their verified rank and scale. Relevant specifications are as follows:
1). To qualify for the award, shipping organizations must have their registered address and actual operation site in the area, and their date of registration must be later than when the measures were put into force.
2). If confirmed through the assessment of their influence at home and abroad and their rank and scale by the Huangpu Harbor-bordering Economic Zone Administrative Committee, international-order functional shipping organizations will receive an award of 3 million yuan; national-order functional shipping organizations 1.5 million yuan; and regional-order ones 500,000 yuan.
Article 11. The procedures to award qualified enterprises or organizations who have applied for the Project Entry Award are as follows:
1). The investment promotion administration in the area will carry out auditing based on the written qualification verdict issued by the Huangpu Harbor-bordering Economic Zone Administrative Committee and the documents provided by relevant enterprises and organizations.
2). The investment promotion administration in the area will bulletin the list of awardees and their sums award for at least five days on the official website of the government of Huangpu district and Guangzhou Development District, or through news media such as newspapers, etc., if necessary.
3). After the bulletining, qualified enterprises or organizations will receive their award by the investment promotion administration in the area.
Article 12. An explanation of some special cases of the Project Entry Award is as follows:
1). Enterprises moving in from outside the area after the date when the measures are promulgated shall be granted an award which is comparable to the Project Entry Award for newly-founded enterprises and pegged to their paid registered capital (divided into two categories: one subscribed outside the area but paid inside and the other both subscribed and paid inside the area) in accordance with the arrangement specified in Article 9 of these articles and in the procedures specified in these articles if, in any year within the term of validity of the measures or within the period stipulated by this article, they have made additional revenues of 20 million yuan or above or have made an additional contribution of 500,000 yuan or above to the local economy. "Additional revenues" refers to the surplus part of their revenues of any year over those of the year just before they move in, starting from the first year they enter the "Forms in One Package" statistical system as a local enterprise (i.e. the first year when their "Basic Data of the Unit Surveyed" form in the system shows that they are located within the jurisdiction of Huangpu district) and within the term of validity of the measures or within the period stipulated by this article. "Additional contribution to the local economy" refers to the surplus of the revenues of any year over the part submitted to the finance of the municipality as a special transfer payment. Enterprises that move in from outside the jurisdiction of the municipality will have their special transfer payment submission to the finance of the municipality taken at zero for the year of their entry. Enterprises that will move into the area between Jan 1 and July 13 in 2025 will be considered qualified enterprises within the term of validity of the measures if they meet the requirement in this article by Dec 31, 2026.
2). If one group corporation and its associated corporations set up a number of companies in the area, no more than three of them will receive the Project Entry Award (including the group corporation itself). If one group corporation and its associated corporations have invested in one another so as to increase their registered capital in two ways, only one of them (including the group corporation itself) shall receive the Project Entry Award.
3). As for domestically-funded enterprises, their paid registered capital shall be evidenced with a special-item auditing report issued by a qualified third-party accounting firm. For foreign-funded enterprises, their paid registered capital shall be evidenced with their capital-surveying report (if invested in any currency other than RMB, it shall be converted to a value in RMB at the exchange rate of the day when the investment is made, and that foreign paid registered capital shall be entered into the statistics of the Ministry of Commerce). Paid registered capital refers to monitory investment only, excluding any other form of investment. To get the Project Entry Award, enterprises or organizations must have been founded and had their registered capital paid within the term of validity of the measures.
4). Enterprises' revenues shall be evidenced with an auditing report issued by a qualified third-party organization.
Chapter Four Operation Contribution Award
Article 13. To any enterprise whose annual revenues reach a certain level, an award will be issued that is equal to 12 percent of its annual contribution to the local economy and that is equivalent to its maximum annual contribution to the local economy in the previous two years, plus 60 percent of the surplus part, with a limit of 50 million yuan. Relevant applicant qualifications and specifications are as follows:
1). Enterprises that apply for such an award must meet at least one of the following requirements:
(1). Enterprises that fall into the categories referred to in the first two subparagraphs of Article 3 of the measures must have their revenues for the year reach 100 million yuan or more and accomplish a year-on-year increase of 6 percent or more;
(2). Enterprises that fall into the categories referred to in the third subparagraph of Article 3 of the measures must have their revenues of the year reach 30 million yuan or more and accomplish a year-on-year increase of 6 percent or more.
2). Enterprises' contributions to the local economy can be divided into a consistent part and an additional part. Take an enterprise's maximum annual contribution to the local economy in the two years just before the support-receiving year to be the datum A (If the maximum is a negative, the datum is taken to be zero, i.e. A=0); take the contribution of the enterprise to the local economy of the year to be B.
(1). If B>A (which means that the enterprise's contribution of the year to the local economy has positively increased, compared with the previous two years), then the additional part = B-A, and the consistent part = A; and the sum of the Operation Contribution Award to the enterprise = A×12 percent+(B-A)×60 percent.
(2). If B≤A, (which means that the enterprise's contribution of the year to the local economy has declined or seen no increase, compared with the maximum in the previous two years), then the additional part = 0, while the consistent part = B; and the sum of the Operation Contribution Award to the enterprise = B×12 percent.
3). Enterprises registered as undersized (below the cut-off level) that have reached the designated size (the cut-off level) or above for the first time will not be granted such an award in the year when they apply to be entered into the "Forms in One Package" statistical system.
Article 14. Newly-registered enterprises that have achieved their first monthly revenue increase after they are entered into the "Forms in One Package" statistical system within the term of validity of the measures will be awarded 100 percent of their annual contribution to the local economy in the year of their first monthly increase (including the total sum of the Business Elite Award they may obtain). If they achieve a year-on-year revenue increase of 10 percent or above in the second and third year, they will be awarded 60 percent of their appropriate annual contribution to the local economy. Relevant applicant qualifications and specifications are as follows:
1). To apply for such an award, newly-registered enterprises must meet all the following requirements:
(1). Enterprises must be registered and founded in the area within the term of validity of the measures, with their date of founding being that registered on their business license;
(2). Enterprises must achieve a monthly revenue increase after being entered into the "Forms in One Package" system within the term of validity of the measures;
(3). Enterprises that fall into the categories referred to in the first two subparagraphs of Article 3 of the measures must have their revenues of the year of their first monthly revenue increase reach 100 million yuan or more, and enterprises that fall into the categories referred to in the third subparagraph of Article 3 of the measures must have their revenues of the year of their first monthly revenue increase reach 30 million yuan or more.
2). To enterprises that meet such requirements, the Operation Contribution Award will be granted for three consecutive years, starting from the year when they are entered into the "Forms in One Package" system. In the first year, they will be awarded 100 percent of their contribution to the local economy in the year (including the total sum of the Business Elite Award they may obtain). If they achieve a year-on-year revenue increase of 10 percent or above in the second and third years, they will be awarded 60 percent of their appropriate annual contribution to the local economy. If their year-on-year revenue increase in the second year is below 10 percent, they will not be granted the award that year or in the next year. But they are qualified as existing enterprises to apply for the award specified in the previous Article 13.
3). Enterprises established by Oct 1 last year shall be categorized as enterprises with a monthly revenue increase if they reach the designated size (the cut-off level) for enterprises to be entered into the "Forms in One Package" statistical system in the area in the current year, with the current year being the year of their first monthly revenue increase. The year of their first monthly revenue increase is just the year when they are first entered into the "Forms in One Package" statistical system.
4). Enterprises shall not be granted such an award if they, as the project party (the investing party), have concluded their land leasing contract with the area prior to the implementation of the measures but are not registered until within the term of validity of the measures.
5). Enterprises shall receive no support authorized under Article 17 of these articles if they have obtained the support authorized under this article for a particular year.
Article 15. Other provisions related to the Project Contribution Award are as follows:
1). Newly-registered enterprises shall not increase their additional economic contribution or additional revenues through transferring production capacity or revenues from enterprises which have already been registered and been operating in the area. If such is the case with any enterprise, the enterprise will lose its qualification to apply for the award. If the enterprise has passed its qualification verification or has obtained the award, its qualification verification will be canceled or the award given to it will be reclaimed.
2). Enterprises' annual contribution to the local economy shall be determined by individual fund-releasing departments based on the data feedback from relevant departments in charge of various channels of contribution to the local economy.
Article 16. An explanation of some special cases of the Operation Contribution Award in the measures is as follows:
1). Enterprises shall be considered to meet the requirement for a first monthly revenue increase if they move into the area within the term of validity of the measures, with their statistical accounts moved into the area no later than the year next to that when their registered address moves in. Enterprises whose registered address will be moved between Jan 1 and July 13 in 2025 shall be considered to meet such requirements if their statistical accounts are to be moved in as of Dec 31, 2026.
2). To qualify for the award, enterprises' additional revenues for the year when they are first entered into the "Forms in One Package" statistical system as a local enterprise (i.e. the first year when the "Basic Data of the Unit Surveyed" form in the system shows that they are located within the jurisdiction of Huangpu district) shall reach the level specified in the first subparagraph of Article 14 in these articles, after subtracting their revenues of the year just before moving in.
3). To a newly-moved-in enterprise who meets all the above requirements, the Operation Contribution Award will be granted for three consecutive years, starting from the first year when it enters the "Forms in One Package" system as a local enterprise. In the first year, it will be awarded 100 percent of its additional contribution to the local economy in the year (including the total sum of the Business Elite Award it may obtain). If it achieves a year-on-year revenue increase of 10 percent or above in the second and third years, it will be awarded 60 percent of the appropriate annual additional contribution to the local economy. If its year-on-year revenue increase in the second year is below 10 percent, it will not be granted the award in that year or the next year. But it is qualified as an existing enterprise to apply for the award specified in Article 13 of these articles.
Article 17. Modern shipping service enterprises registered as undersized (below the cut-off level) that have reached the designated size (the cut-off level) for the first time within the term of validity of the measures will each be given a one-time award of 100,000 yuan.
Chapter 5 Business Elite Award
Article 18. Business elites who meet the requirements in the first and second subparagraphs of Article 4 in the measures, which is about the Operation Contribution Award, are all qualified for the Business Elite Award under Article 5 of the measures. Relevant levels of the award and specifications are as follows:
1). The list and the placement of applicant business elites shall be determined by the enterprise itself and a collective application shall be made. The applicant elites shall be in-service staff members of the enterprise itself and pay their taxes in the area.
2). The sums of the award amount to 15 percent of the part of taxable personal incomes that comprise the salaries and share interest issued to the elites by the enterprise itself. (The taxes on the above two items shall both be paid in the rea). The number of awardees of each enterprise shall not exceed 10. The sums of the award shall be no more than 100 percent of the payable (and actually paid) personal income taxes of the awardees, with a limit of 3 million yuan per capita per annum.
3). Each year, the accumulated sum of the award to each enterprise shall not exceed 30 percent of the enterprise's contribution to the local economy that year.
4). The taxable personal incomes comprising salaries and share interest and the payable (and actually paid) personal income taxes concerned in this article shall be calculated in accordance with the Guidebook to Settling Personal Taxable Items for the Whole Area. The accumulated sum of the award will be put into the account of the enterprise. The enterprise executes the payment of personal income taxes in place of the awardees according to the relevant regulations of the country on the taxation of personal awards. The amount left after the taxation will be put into the accounts of the business elites.
Chapter 6 Office Housing Subsidy
Article 19. Qualified modern shipping service enterprises and shipping organizations shall receive an office housing subsidy if they have rented their office houses in the area. Relevant subsidy levels and specifications are as follows:
1). To apply for such subsidy, enterprises must have been founded and expanded to the designated size within the term of validity of the measures; shipping organizations must fall into one of the categories specified in Article 8 of these articles and be newly registered in the rea within the term of validity of the measures, with their registered address and actual office address in the area.
2). Qualified enterprises or organizations that have rented their office houses in the area and for their own use shall receive a subsidy of 50 percent of their actual rent, with a limit of 600,000 yuan per annum for each enterprise or organization.
3). Qualified enterprises or organizations must apply for the office housing subsidy for their actual rental months in a natural year within the term of validity of the measures. The application must be made in the year just following the year of their actual rental (taken to be the implementation time registered in their rental contract documented in the local community office).
4). The expression "rented office houses" in this article refers to the houses enterprises or organizations have rented for their own use, whose area is taken to be that registered in the rental contract documented in the local community office (excluding affiliated dining halls, garages, warehouses, etc.). During the subsidized period, enterprises or organizations must not sublease the whole or a part of their office houses to others, and must not change for the use of their office houses at will.
Article 20. Qualified modern shipping service enterprises and functional shipping organizations shall receive an office housing subsidy if they have purchased their office houses in the area. Relevant subsidy levels and specifications are as follows:
1). To apply for such a subsidy, enterprises must be founded and expanded to the designated size or above within the term of validity of the measures; functional shipping organizations will fall into one of the categories specified in Article 8 of these articles and be newly registered in the area within the term of validity of the measures, with their registered address and actual office address in the area.
2). Qualified enterprises or organizations who have purchased their office houses for their own use shall receive a one-time office housing subsidy of 1,000 yuan per square meter for the area of the office houses (taken to be the surveyed area registered in the property ownership certificates, excluding affiliated dining halls, garages, warehouses, etc.), with a limit of 3 million yuan.
3). Enterprises or organizations applying for the office housing subsidy must have purchased their office houses within the term of validity of the measures. The application shall be made in the year following the year of their actual purchases (taken to be the time when their house transaction contracts are put into force). The purchased office houses concerned in this article refer to the office houses enterprises or organizations have purchased for their own use.
Article 21. Article 19 and Article 20 in these articles shall not apply at the same time.
Article 22. Enterprises or organizations who have moved into the area within the term of validity of the measures and have achieved a year-on-year revenue increase from the year prior to moving in shall be granted the Office Housing Subsidy, with relevant qualification requirements and levels of the subsidy comparable to those for newly registered enterprises or organizations specified in Article 19 and Article 20 in these articles. Modern shipping service enterprises and functional shipping organizations which have purchased land in the area will not be granted the Office Housing Subsidy again.
Chapter 7 Capacity Upgradation Award
Article 23. Enterprises or organizations shall receive the Capacity Upgradation Award if they have opened new international cruiser or pleasure ship routes from Huangpu. Relevant levels of the award and specifications are as follows:
1). Cruiser companies who use the ports or docks within Huangpu district as their port of departure (home port) for their operation on new international cruiser excursion routes shall be awarded according to cruiser tonnage and the number of voyages completed: for cruisers of Type A (with a gross tonnage between 20,000 tons and 40,000 tons inclusive), 20,000 yuan per round-trip voyage; for cruisers of Type B (with a gross tonnage between 40,000 tons and 70,000 tons), 30,000 yuan per round-trip voyage; and for cruisers of Type C (with a gross tonnage of 70,000 tons and above), 50,000 yuan per round-trip voyage.
2). Cruiser companies who operate on the Guangzhou cruiser excursion market on new routes starting from Huangpu and have accomplished 10 round-trip voyages or more shall be awarded according to the distance their cruisers travelled from the ports (or docks) in Huangpu district on a single round-trip voyage: for cruiser companies whose cruisers travelled 1,000 nautical miles or less on a single round-trip voyage, a one-time award of 500,000 yuan; for cruiser companies whose cruisers travelled 1,000 to 2,000 nautical miles on a single round-trip voyage, a one-time award of 800,000 yuan; and for cruiser companies whose cruisers travelled 2,000 nautical miles or more on a single round-trip voyage, a one-time award of 1 million yuan.
3). Newly-built cruisers who choose ports or docks in Huangpu district as their home port to start their virgin voyage shall be awarded according to the number of voyages they have accomplished: for cruisers with five or more consecutive round-trip voyages, a one-time award of 250,000 yuan; for those with 10 or more consecutive round-trip voyages, a one-time award of 600,000 yuan; and for those with 15 or more consecutive round-trip voyages, a one-time award of 1,200,000 yuan.
4). The "new routes" and "newly-built cruisers" concerned in this article are taken to be those with an administrative license or other materials issued and documented by a transportation or shipping department. Only the enterprise or organization which has obtained the first administrative license on a particular shipping route is qualified to apply for the award for the "new route" concerned.
Article 24. Pleasure ship companies who operate on Pearl River excursion routes starting from or ending at ports or docks in Huangpu district between Huangpu and Tianzi Dock, Dashatou Dock, Guangzhou Tower Dock, etc. shall be awarded 500,000 yuan per small-size pleasure ship (accommodating 250 or less tourists), 700,000 yuan per medium-size pleasure ship (accommodating 250 to 350 tourists), and 1 million yuan per large-size pleasure ship (accommodating 350 or more tourists), for every 50 round-trip voyages they have made.
Article 25. Yacht companies who operate do-it-yourself hop-on hop-off yacht excursions to Hong Kong and Macao starting from ports or docks in Huangpu district shall be awarded 100,000 yuan per small-size yacht (accommodating 50 or less tourists), 200,000 yuan per medium-size yacht (accommodating 50 to 100 tourists), and 300,000 yuan per large-size yacht (accommodating 100 or more tourists), for every 20 round-trip voyages they have made.
Article 26. Enterprises or organizations who have opened new international cruiser or pleasure ship routes from Huangpu, new Pearl River excursion routes via Huangpu, and new Hong Kong-Macao do-it-yourself excursion routes to and from Huangpu shall be awarded in accordance with what is specified in Articles 23 to 25 in these articles, with a limit of 20 million yuan per enterprise or organization per annum. With respect to the different award levels, companies who have reached a lower level and above may apply for a compensatory award for their surplus above that level.
Article 27. The numbers of round-trip voyages concerned in Articles 23 to 25 in these articles are taken to be what is registered in the statistics of relevant port authorities; the tonnages, distances, accommodation etc. concerned are taken to be what is stated in the administrative licensing documents issued by relevant transportation or shipping departments.
Article 28. Specialized training organizations or companies qualified for training in specialized shipping skills and training for special work stations are welcome to the area and conduct their training business in the area. If they have conducted training in specialized shipping skills and training for special work stations, and their trainees have obtained their nationally-accepted qualification certificates, organizations shall be granted an award of 200 yuan per certificate holder, with a limit of 3 million yuan in the sum total per organization per annum. Relevant specifications are as follows:
1). To apply for the award, specialized training organizations or companies must submit their training-related materials (including training batch arrangement, training nomination, training items, training sizes, training budgets, training notices, training achievements, etc.) of the year to Huangpu Harbor-bordering Economic Zone Administrative Committee before Sept 30 that year, which are to be kept on file by the Huangpu Harbor-bordering Economic Zone Administrative Committee.
2). To be qualified to apply for the award for training in specialized shipping skills and training for special work stations, specialized training organizations or companies must meet all the following requirements:
(1). Applicant training organizations or companies must be registered in the area and pay their taxes in the area;
(2). Applicant training organizations or companies must possess relevant qualification documents issued by the Ministry of Communications (including its affiliated units);
(3). Their trainees must have been issued with their competence certificates by the Ministry of Communications (including its affiliated units);
(4). For the majority of the time (above 60 percent of the time), they must conduct their training business in the area.
3). Individual qualified organizations shall receive at most 3 million yuan per annum, not to exceed the actual training costs of the organizations.
Chapter 8 Industrial Clustering Award
Article 29. For modern shipping service industrial parks which have been launched with a business office area over 10,000 square meters, of which modern shipping service business accounts for more than 50 percent, an Industrial Clustering Award will be issued, once they pass relevant verifications, and with a limit of 500,000 yuan per annum as per their actual overhead expenses. Relevant specifications are as follows:
1). An award of 400,000 yuan shall be granted to park operators meeting the following requirements:
(1). Park operators must have established proper and standardized management organizations and operational schemes and are able to conduct the building-up, management and operation of their industrial park effectively;
(2). The modern shipping service enterprises in the parks must be registered with their addresses in the parks and actually operate in them. The registration information in their business license or any registration-related credentials must be adopted;
(3). Industrial parks must comply with relevant fire protection and safety production regulations.
2). Park operators meeting the requirements of the first subparagraph of this article shall receive an extra award, with a limit of 100,000 yuan, if they are verified to meet the following requirements:
(1). Parks shall be awarded 20,000 yuan per natural year for each functional shipping organization, as defined in the measures, which is added year on year;
(2). Parks shall be awarded 40,000 yuan per natural year for each modern shipping service enterprise of the designated size or above, as defined in the measures, which is added year on year;
(3). Parks shall be awarded 20,000 yuan per natural year for each modern shipping service enterprise, as defined in the measures, which is added year on year;
(4). Parks shall be awarded 10,000 yuan per natural year for each 1 percent year-on-year increase in business office area provided for modern shipping service enterprises;
(5). The highest applicable award shall be issued, and each park shall be granted only one award.
3). As for industrial parks which are verified to meet the requirements stipulated in the first subparagraph of this article for the first time since the implementation of the Measures to Boost the Development of the Modern Shipping Service Industry in Huangpu District and Guangzhou Development District in the Municipality of Guangzhou (GDD Management Committee Resolution [2017] No 33), their operator shall be directly awarded 500,000 yuan.
4). The business office area concerned in this article shall be taken to be what is stated in relevant Property Ownership Certificates or relevant house rental contracts documented in relevant local community offices, excluding affiliated dining halls, garages, warehouses, etc.
Chapter 9 Shipping Culture Promotion Award
Article 30. Each shipping conference, activity, forum, etc. which has been held in the area, which has a certain level of influence, and is expected to help promote the development of the shipping industry in the area, shall be awarded 50 percent of the actual total expenses of the activity after relevant verifications, with a limit of 1 million yuan. Relevant specifications are as follows:
1). To be qualified to apply for the award, modern shipping service enterprises or organizations must meet the following requirements:
(1). The sponsor or delegated organizer must have its registered address and its taxation and statistical accounts within the jurisdiction of the area, have a sound accounting system, exist as an independent corporation and carry out independent accounting;
(2). The participants must be representatives from transportation and shipping management departments at all levels, as well as modern shipping service units, enterprises or organizations (necessarily including renowned shipping service units, enterprises or organizations) located in most of the cities in the Pearl River Delta region or from five or more provinces, autonomous regions, municipalities directly under the central government or special administrative regions;
(3). The invited guests must include reasonably well-known and influential experts, scholars or entrepreneurs in the domestic shipping industry;
(4). Five or more renowned public media outlets at the prefecture level or above and shipping-specific specialized media must promote the activity.
2). Enterprises or organizations must submit relevant written materials (including the relevant application, budget plan, process plan, etc.) to Huangpu Harbor-bordering Economic Zone Administrative Committee for filing at least 60 days in advance of the event, and submit relevant written materials as well as the invoices of the expenses of the activity to the committee within 30 days of the closing of the event, which shall be audited jointly by the Huangpu Harbor-bordering Economic Zone Administrative Committee and relevant departments. The award shall be issued in accordance with the result of the audit.
Article 31. The Shipping Culture Promotion Award is exclusively applicable to the sponsors or delegated organizers of shipping cultural activities, with only one awardee per activity. Each enterprise or organization can be granted the award only once per year. If an activity has been funded jointly with the government, the actual expenses of the relevant enterprise or organization shall be the remains of the total expenses after the subtraction of the part from the government.
Chapter 10 Annex
Article 32. Any enterprise or organization meeting the requirements for various awards within the term of validity of the measures or the period designated by the measures can apply for the awards. Applicant enterprises or organizations must make their application at the policy implementation department of the administrative service center of the district and at the time it announces. Any delay shall be considered to be a waiver. Information on relevant application procedures and materials required to be submitted shall be obtained from the operational guides to various awards publicized by relevant departments in the policy implementation system.
Article 33. The policy implementation department of the district shall accept applications and carry out form verification. Applicants shall be notified within five working days if their application fails to pass the verification or they need to add or correct application materials. The applications which have passed the form verification shall be forwarded to appropriate funds-releasing departments for content verification. The applicants whose application has passed the content verification shall receive their award money by appropriate funds-releasing departments in appropriate procedures.
Article 34. The term "primary business" in these articles refers to shipping–related businesses which are part and parcel to the whole business of enterprises and organizations in terms of business scope and revenue.
The categorization of "designated size or above" in the measures shall be based on what is stated in the "Basic Data of the Unit Surveyed" form and the Accounting Report which enterprises or organizations have downloaded from the "Forms in One Package" statistical system, printed and stamped. Enterprises' "establishment" and "registration" in the measures shall be verified by referring to their time of registration. Enterprises or organizations' moving in as a special case of "establishment" and "registration" shall be verified by referring to the time when they change their registered address. Enterprises or organizations' revenues shall be verified by what is stated in the accounting auditing report issued by a qualified third-party organization and submitted by the enterprises or organizations.
In the measures, enterprises or organizations' revenues and contribution to the local economy are expressed in 10,000 yuan (leaving out the endings). Year-on-year increase rates are accurate to one decimal place (leaving out the endings). The sums of the awards concerned in the measures are expressed in RMB. The actual sums of the awards issued are accurate to 10,000 (leaving out the endings).
In these articles, the term "additional contribution to the local economy" refers to the surplus of enterprises' contribution to the local economy of the year after the subtraction of the part submitted to the finance of the municipality as a special transfer payment. For enterprises which have moved into the jurisdiction of the municipality, the submission of the special transfer payment to the finance of the municipality is taken to be zero for the year of their moving in.
Article 35. Unless noted to be any other currency, the currency used in the measures is always RMB. Quantities with terms "以上", "以下", "达到", "不少于", and "不超过" all include the quantities proper (unless specified otherwise in the articles). In the implementation of these articles, any conversion between RMB and any other currency shall be made at the exchange rate issued by the People's Bank of China on the day when relevant applications for awards are verified.
Article 36. One and the same project or item to which both the measures and other regulations on incentives of the area (including those made by superior authorities stipulating match-up or whole funding from the area) or regulations for the support to key projects apply shall be awarded following the principle of "whichever award is the highest, and no repetition". Enterprises or organizations can apply for only one of them.
Article 37. Award money shall be deposited directly into the basic account of qualified enterprises or organizations, following the verification by relevant funds-releasing departments of Huangpu district and Guangzhou Development District based on materials including the auditing reports issued by qualified third-party organizations and submitted by the enterprises or organizations, the data on their contribution to the local economy provided by relevant functional departments, etc. The taxes on awards for enterprises or organizations, or individuals shall be paid by them respectively.
Any agency or individual is forbidden to illegally hold back, embezzle, indiscriminately use or falsely claim the awards. The award funds issued to enterprises shall be spent on business operation and expansion activities exclusively. Holding back, cutting into, embezzling, and abusing award funds shall be taken as a breach of the measures and punished in accordance with Penalty and Fine Rules for Illegal Financial Acts. The responsibility of relevant persons shall be determined.
Article 38. The division of duties relevant to the measures among relevant departments is as follows:
1). Huangpu Harbor-bordering Economic Zone Administrative Committee is responsible for issuing a written verdict on whether an applicant enterprise or organization falls into one of the categories of modern shipping service enterprises and functional shipping organizations concerned in the measures.
2). The support items under the measures shall be settled in an all-in-one-door pattern. The policy research office of the district is in charge of overall coordination, application reception, form verification and the monitoring and supervision of the implementation process. The investment promotion department, the commerce bureau, the culture, broadcasting, television and tourism bureau, and Huangpu Harbor-bordering Economic Zone Administrative Committee carry out content verification. All units shall discharge their duties within the respective periods for settlement stated in the measures. The policy implementation information service system of Guangzhou Development District is the sole platform to issue relevant guides to settlement and public notices and announcements.
3). The investment promotion department of the district is in charge of discharging the Project Entry Award under Article 3 of the measures; the commerce bureau, the Operation Contribution Award, the Business Elite Award, and the Office Housing Subsidy under Article 4, Article 5 and Article 6 of the measures respectively; the culture, broadcasting, television and tourism bureau, the Quality Upgradation Award under the first subparagraph of Article 7 in the measures; and Huangpu Harbor-bordering Economic Zone Administrative Committee, the Quality Upgradation Award under the second subparagraph of Article 7 in the measures, the Industrial Clustering Award under Article 8 in the measures and the Shipping Culture Promotion Award under Article 9 in the measures.
4). The administration for market regulation and the administration for construction and transportation in Huangpu district and Guangzhou Development District are in charge of categorizing enterprises. The administration for planning and for conservation of natural resources shall provide evidence of enterprises' purchase of land and office houses. Local community offices are in charge of verifying and providing the documentation of relevant house rental contracts. The financial administration in Huangpu district and Guangzhou Development District are in charge of issuing funds and providing the data on enterprises' contribution to the local economy. The auditing department in Huangpu district and Guangzhou Development District are in charge of supervising the use and management of relevant funds and making performance evaluation.
Article 39. The funds required under the measures shall be arranged by the government of Huangpu district and Guangzhou Development District Administrative Committee, be incorporated into the annual budget of the investment promotion department of the district, the commerce bureau, the culture, broadcasting, television and tourism bureau, and Huangpu Harbor-bordering Economic Zone Administrative Committee respectively, and be released after verification by relevant functional departments in accordance with relevant regulations of Huangpu district and Guangzhou Development District.
Article 40. The use and management of the funds under the measures shall obey relevant national laws, regulations, and policies, strictly observe the national financial funds management regime and be subject to the supervision by the financial, auditing and other departments of Huangpu district and Guangzhou Development District.
If applicant enterprises or organizations cheat for award funds under the measures, the award funds issued to them shall be taken back by relevant funds-releasing departments in Huangpu district and Guangzhou Development District of the municipality of Guangzhou. Their dishonest behavior shall be entered into the Guangzhou Public Credit Information Management System for joint punishment in accordance with relevant laws and regulations. No application for awards by relevant enterprises or organizations shall be accepted within three years. If a crime is committed, the offending party must bear the legal responsibility for the crime. Those enterprises or organizations who have returned relevant awards on their own in accordance with their letter of commitment shall be exempted from getting their dishonest behavior publicized.
Article 41. These articles shall come into force as of the date of promulgation and shall remain valid until July 13, 2025.
