Notice on Adoption Registration by overseas Chinese and the Chinese citizens living in regions of Hong Kong, Macao, and Taiwan

I. Department of Acceptance

II. Responsibilities of the Department

According to the law, the department is in charge of Nanyang's adoption registration work. It is also in charge of promoting the adoption law and the legal adoption process.

III. Regulations and Laws

The "Adoption Law of the People's Republic of China" and the "Measures for Registration of Adoption of Children by Chinese Citizens, Provisions on the Jurisdiction of Adoption Registration Handled by Overseas Chinese and the Chinese Citizens Living in the Regions of Hong Kong, Macao and Taiwan and the Required Certificates and Certificate Documents"

IV. Registration Requirements

1. The adopter(s) should be the age of 30 or older;

2. The adopter(s) should have no prior children;

3. The adopter(s) should be capable of supporting and educating the adoptee;

4. The adopting couple should suffer no such disease as is medically regarded as unfit for adopting a child;

5. The adopting couple should adopt children together;

6. Overseas Chinese and the Chinese citizens living in the regions of Hong Kong, Macao and Taiwan regions adopting a child on the mainland should apply for adoption registration in the civil administration department of the municipality, city with districts, autonomous prefecture or regional administrative office of the adoptee’s permanent residence place;

7. The adopter(s), adoptee’s guardian and adoptee should be present at the same time;

V. Documents and Certificates by the Adopters

(I) Documents and certificates by overseas Chinese whose country has established diplomatic relations with China

(1) Passport;

(2) Papers certifying such particulars of the adopter such as age, marital status, whether the adopter has a previous child, profession, property details, health report and whether the person has ever been subjected to a criminal punishment, which are issued by the competent agencies of the country to which the adopter belongs. Such certifying papers shall be authenticated by a foreign affairs institution of the country to which the adopter belongs or by an agency authorized by the said institution and by the embassy or consulate of the People’s Republic of China stationed in the country concerned;

(II) Documents and certificates by overseas Chinese whose country has not established diplomatic relations with China

(1)   Passport;

(2) Papers certifying such particulars of the adopter such as age, marital status, whether the adopter has a previous child, profession, property details, health report and whether the person has ever been subjected to a criminal punishment, which are issued by the competent agencies of the country to which the adopter belongs. Such certifying papers shall be authenticated by a foreign affairs institution of the country to which the adopter belongs or by an agency authorized by the said institution and by the embassy or consulate of a third country  which has established diplomatic relations with China stationed in the country concerned;

(III) Documents and certificates by Chinese citizens living in the special administrative region of Hong Kong

(1) Hong Kong Resident Identity Card, Mainland Travel Permit for Hong Kong Residents or Home Return Certificate for Compatriots from Hong Kong; 

(2) Papers certifying such particulars of the adopter such as age, marital status, whether the adopter has a previous child, profession, property details, health report and whether the person has ever been subjected to a criminal punishment, which are entrusted by competent national agencies. Such certifying papers shall be certified by Hong Kong commissioned notaries;

(IV) Documents and certificates by Chinese citizens living in the special administrative region of Macao

(1) Macao Resident Identity Card, Mainland Travel Permit for Macao Residents or Home Return Certificate for Compatriots from Macao;

(2) Papers certifying such particulars of the adopter such as age, marital status, whether the adopter has a previous child, profession, property details, health report and whether the person has ever been subjected to a criminal punishment, which are issued by Macao competent agencies;

(V) Documents and certificates by Chinese citizens living in Taiwan

(1)   Valid proof of residence in Taiwan;

(2)Travel documents issued or endorsed by the competent authority of the People’s Republic of China ;

(3) Papers certifying such particulars of the adopter such as age, marital status, whether the adopter has a previous child, profession, property details, health report and whether the person has ever been subjected to a criminal punishment, which are notarized by notary authorities in Taiwan.

(3)   Filling in application forms of adoption registration

(4)   Examination

(5)   Reception of adoption registration certificate

VII. The Duration and Results

The adoption registration authority must conduct examination within 30 days from the next day of the receipt of the registration application for adoption of children in China. When the requirements above are met, the adoption must be registered for the parties, and an adoption registration certificate must be issued. When the requirements above are not met, the adoption must not be registered and a written notification with reasons must be sent out.
